TERMS AND CONDITIONS OF USE OF THE CAMINOTOOL PLATFORM

1. OBJECT

Dinamedia Soluciones Técnicas, SLU, with CIF B70507553 and domicile in Travesa da Poza, 20, Santiago de Compostela, 15706, A Coruña, dedicated among other activities of its corporate purpose, to the development, design, development and control of marketing campaigns and advertising, is the holder of the CaminoTool platform (hereinafter also the “Platform”) through which a system is proposed in which personal and direct participation of final consumers is obtained interactively through mobile terminal devices (“ Tablets or Smartphones ”) and the possibility of benefiting from discounts on the products and / or services of the retail stores attached to the Platform, all of them belonging to the Camino de Santiago.

2. PARTICIPATION AND MECHANICAL REQUIREMENTS OF THE PLATFORM

In order to participate in the Platform it will be necessary to have reached the age of 18 and follow the following steps:

Access the Platform through the application, which must be installed on a mobile device, and available in the main stores or official stores.
The User must provide their Google email in order to register their account and access to the Platform, and thus be able to benefit from all the benefits associated with it.
When the User has validated his account, a virtual wallet will be provided. From that moment on, the User will be the owner of a CaminoTool account associated with an email account. In addition, you can indicate your associated PayPal or HalCash account, so that transactions and discounts can be completed through them.
In the event that the User decides to enter their email in the Platform, the system will generate a complementary validation process for the effective verification of their ownership and thus avoid sending unsolicited communications, the User must accept the conditions of use of the platform, as well as the specific rules on data protection, reproduced below.
The User may enter other optional fields, such as a mobile phone number, date of birth, sex, address and initial stage of his Way among others.

3.PURCHASES AND OPERATION

CaminoTool will make available to the user a complete guide of adhered stores and establishments, most of which will offer the possibility of benefiting from a promotional discount for the use of this platform. Of these establishments, some may be clearly and visibly identified, with a sign indicating “Accept CaminoTool payments”.

To benefit from the discount, the User must show their status as a pilgrim under the terms and conditions described below, pay for the purchase of products and / or services and request the corresponding ticket. Once this is obtained, the establishment chosen on the application map must be selected and the following identification fields of the ticket must be introduced: (i) Ticket number; (ii) Date and time; (iii) total amount and (iv) number of people involved or participants in the purchase or acquisition of products and / or services.

Ticket validations will have exceptions, which will be duly indicated. Thus, accommodation reservations made through aggregators or agencies are not included as valid operations in CaminoTool, only those made by the user in the establishment being covered. In pharmacies, purchases of medications or prescriptions cannot be validated.

3.1 Purchases made with cash / card

The application will register the purchase and request confirmation from the establishment, who must proceed with its validation by entering the store PIN code, made by the authorized personnel of the establishment.

Once this is done, the pilgrim must complete the experience valuation form, after which the percentage discount offered at the establishment will be entered in their virtual wallet, provided that the user is not incurred in some of the limitations explained later.

In case of not having a connection to the network, the validation and valuation of the transaction is pending of its effective reception by CaminoTool, and must be received by it before the forty-eight hours (48 h) following to have occurred. Otherwise, the User may not benefit from the amount of the promotion or discount.

3.2 Purchases made with CaminoTool credit

Pilgrims may make purchases from their virtual wallet, and must validate the purchase as planned for those made with cash or card. If the available balance is sufficient to make the purchase, its virtual wallet value will be deducted. If the balance is insufficient, the pilgrim may use the existing credit in the virtual wallet, paying the remaining amount in cash or card.

In any case, the purchase from the virtual wallet may be requested if the user has the status "Certified Pilgrim". This condition is automatically granted by CaminoTool to all those users who have validated a ticket in five (5) different establishments.

3.3 Accreditation of pilgrim status

The pilgrim undertakes to identify himself before the trade if he is required to do so, which must be done by displaying the official credential, which must be sister-in-law not later than 24 hours.

3.4 Specific conditions of use

The pilgrim must make an objective and real assessment of the shopping experience in the establishment where the application will be used, always and prior to the validation by the merchant. Its non-realization may lead to the invalidation of the purchase and, therefore, the non-refund of the discount offered.

The pilgrim can only exchange the tickets of their own purchases, not being able to use third party tickets.

It could be the case that the User's mobile device did not have coverage during the validation process, so the application will cache the transaction made, and the device must connect to the Internet before the 48 hours following the completion of that one, expiring the same otherwise and not counting the discount obtained.

CaminoTool has expressly established quantitative limits for the use of the application and obtaining discounts, which the user knows and accepts. In that sense, the same user can only validate two tickets per establishment and day. To older, CaminoTool establishes a maximum bonus amount, placing this in FIFTY (50) Euros per ticket and FIVE HUNDRED (500) daily.

3.5 Returns

The user expressly acknowledges that the establishment, in compliance with consumer legislation, is not obliged to return the purchased products. However, if the parties agree to make any type of compensation or reimbursement of the amounts delivered, this must be done without the participation of CaminoTool, and must be satisfied or compensated between them, so that this second transaction cannot be made from the funds. accumulated by the user, nor alter the discount generated in the first, as well as the satisfaction of the Canon of CaminoTool.

4 SETTLEMENTS

The pilgrim, apart from the use of the amounts accumulated as discounts obtained in the purchases, for the exchange and payment of new acquisitions, may make provisions of the remaining credit only when it exceeds FIVE EUROS (€ 5). For this, CaminoTool will make the corresponding deposit in the PayPal account indicated at the time of the request, which will be effective within a maximum period of SEVEN (7) Days.

If the balance of the pilgrim is greater than TWENTY EUROS (€ 20), you can make arrangements at Hal-Cash ATMs, always in multiple amounts of TWENTY EUROS (€ 20). These settlements are executed within a maximum period of 24 hours after receipt of the request.

In any case, a settlement can only be requested if the user has the status "Certified Pilgrim". This condition is automatically granted by CaminoTool to all those users who have validated a ticket in five (5) different establishments.

5. PERSONAL DATA PROTECTION

To access the Platform we will only ask for the Google email address of our Users so they can interact with the establishments, benefit from their discounts, as well as personalized promotions and discounts, redeeming them in the establishments themselves reflected in the application, this that is, those that are shown on the map of establishments and have an active offer.

In addition, the User may provide his email address and thereby access the private area of ​​his profile and complete the rest of personal data. The system will validate this address by sending a verification email that the User must accept and which will include the present conditions of use.

This and other security measures have been adopted in order to comply with European privacy standards and Spanish regulations, specifically the Organic Law 15 / 1999, of December 13, on the Protection of Personal Data. By virtue, all the data provided will be incorporated into the files of CaminoTool, duly registered in the Spanish Agency for Data Protection, with the sole purpose of managing the contractual and commercial relationship with users, applying discounts and redeeming them, as well as send you commercial and promotional communications from the shops adhered to the Platform.

The User may exercise the rights of access, rectification and cancellation of their data through the personal area of ​​the application, by written request addressed to CaminoTool and the opposition, revoking the consent given to receive commercial communications, in any of the communications received in your email through a simple procedure, as well as through the aforementioned procedures.

The User expressly consents, in case of carrying out promotions and raffles, the use and dissemination of their public image and the communication of their data to the sponsors, whether this is necessary for the enjoyment of the prize, even for the purpose of advertising in those media in which CaminoTool is present.

6 ACCEPTANCE OF TERMS AND CONDITIONS

Users of the Platform, by the mere fact of enabling a User code, fully accept these terms and conditions and the criteria of CaminoTool regarding the resolution of any issue arising from the development of the service and raffles carried out. Any technical incident related to the service may be communicated to the telephone number indicated in the application, without in any case the identification of the User. Non-acceptance of the Terms implies the exclusion of the User from the Platform.

CaminoTool may modify or change the regulatory terms and conditions of the Platform, which will always be available and accessible to the Users, so their periodic consultation is recommended. Any promotion may be extended or suspended at any time, provided that CaminoTool deems it appropriate, which will be communicated in due course in any of the means used in the Platform.

7 LOW PLATFORM

Users may request to unsubscribe from the platform, by checking the box enabled in the private area existing on the website. Once the withdrawal is requested, it will be processed within a maximum period of ten (10) business days.

CaminoTool reserves the right to cancel the accounts of those users who make inappropriate or fraudulent use of the application, so that it goes against morality, public order and good customs. In those cases, the user profiles will be canceled, with the remaining credit withheld.

If the pilgrim has a complaint related to the trade, he will communicate it directly to CaminoTool, by the means available: from the corresponding section in the “Complaints of commerce” app, or via email quejas@caminotool.com, WhatsApp + 34622062747 or Facebook https://www.facebook.com/CaminoTool clearly indicating the trade.

8 APPLICABLE REGULATIONS

This contract is governed and fully subject to Spanish legislation. To resolve any dispute or claim arising from compliance, breach or interpretation of this contract, you can go to the Spanish courts. Submission to the Consumer Arbitration System to resolve any issue arising from this contract is expressly excluded.

9 INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents, logos, images and badges used in the Platform are owned by CaminoTool or the members and establishments of the Platform, so their use corresponds exclusively to these and are protected by the regulations governing Intellectual and Industrial Property and any another specific in the matter. The User may not make use of those without the express authorization of the owners and will be solely responsible for the violations committed by him or by the persons in charge

9 FINISHING THE PLATFORM

CaminoTool may terminate the Platform at any time without the need for prior communication, although it will try to effectively disseminate it among the members that make it up, so that they can also redeem all credits and benefit from valid discounts and promotions, which will be without effect from the day announced for the end of the service, and cannot be used for any other purpose.

Processing of personal data
In accordance with the provisions of Organic Law 15 / 1999 of Data Protection (LOPD) and its development regulations, we inform you that the personal data you provide, by filling in the electronic registration form that appears on the Website, will be incorporated in a file registered with the Spanish Agency for Data Protection, whose head is Dinamedia Soluciones Técnicas, SLU, (hereinafter CaminoTool) with address in Travesa da Poza 20A 4D, 15706 Santiago de Compostela (A Coruña).

The completion of said form implies the express consent of the user to the treatment by CaminoTool of said data and the assignments specified in this privacy policy.
It is informed that your data will be treated in the most absolute confidentiality, under the protection and specifications contained in the aforementioned regulations in order to serve as a database so that CaminoTool can identify it, provide its services and send you news and information related to said services. You expressly agree that such information may be sent to you by email, or similar means in compliance with Article 21 of Law 34 / 2002, of July 11, of Information Society and Electronic Commerce Services (LSSICE ).

The user can exercise their rights of access, rectification, cancellation and opposition by sending a request by regular mail to the postal address indicated in the first paragraph of this Privacy Policy. Said request must be accompanied by the name and surname of the user, and photocopy of the ID. Likewise, the user may exercise said rights by sending an e-mail, accompanied by a photocopy of a document that proves his identity to info@caminotool.com indicating in the body of the message the desired option.

The user must notify CaminoTool of any modification that occurs in the data provided, responding in any case of the veracity and accuracy of the data provided at any time.

The CaminoTool service is intended for users over 14 years of age. No person whose age is below 14 years is authorized to provide their personal data. When registering, the user declares to be older than 14, being entirely responsible for this statement.

CaminoTool reserves the right to modify this Privacy Policy in accordance with the applicable legislation at any time with the effect of the date of publication of said modification. CaminoTool recommends the user to periodically review this Privacy Policy to be informed of how CaminoTool protects their information

Using Cookies

CaminoTool can send “cookies” to the user's computer or use similar technologies to improve their online experience on the Website and throughout the Internet.
